TERMS & CONDITIONS
By accepting service you are acknowledging that you have read and
understand these terms and conditions and agree to all these terms below. YOU
AGREE TO THESE REPAIR TERMS AND ALL APPLICABLE SERVICES AND DIAGNOSTIC
Video Club/One Stop Repair Shop shall be under no obligation to give the Customer an estimate before
commencing to repair the Goods unless the Customer gives us a written request
for an estimate.
b) Where an estimate is given, Benitachell Video Club/One Stop Repair Shop may delay commencing work
until the Customer gives us written instructions to proceed. If it does not
receive such instructions within 21 days of the date of the estimate, we may
return the Goods to the Customer at the Customer's expense.
c) In the event that Benitachell Video Club/One Stop Repair Shop does not repair or replace Goods
for which an estimate is given, we charge 30€ for the examination, diagnosis and
re-assembly of the goods. The inspection fee is automatically absorbed into the final repair cost if we proceed with the repair. If repair is not undertaken here then the inspection/diagnostic fee must be paid.We shall endeavour to re-assemble the Goods to the
condition in which they were received but shall not be liable to the Customer for any loss or
damage whatsoever resulting from its failure so to do.
3. Standard of Repair
a) Unless otherwise
agreed we shall repair the goods to the manufacturer's specification.b) Bentachell Video Club/One Stop Repair Shop shall at its sole discretion decide:
i. the nature and method of repair
ii. the type of replacement parts to be used
ii. whether the Goods shall be repaired or replaced, in whole or in part. Any
replacements shall be such as we consider suitable and need not be identical to
the Goods being replaced.
c) Please be note that when any device has suffered damage/or is not functioning, repair may be impossible. The device may cease to function after repair is undertaken and One Stop Repair Shop/Benitachell Video Club is not in any way liable for any latent damage or as result of any repair.
4. Delay or Cancellation of Repair or Replacement
Any dates quoted by Benitachell Video
Club for completion of work, repairs or replacement are approximate only and as
such shall not be liable for any loss whatsoever resulting from failure to meet
such dates. Benitachell Video Club/One Stop Repair Shop may postpone or cancel repair work at any
Collection/Delivery of the Goods Any dates or timescales quoted by
Benitachell Video Club for completion of repair work, or replacement are
approximate only and we shall not be
liable for any loss whatsoever resulting from failure to meet such dates Benitachell
Video Club/One Stop Repair Shop may postpone or cancel repair work at any time.
a) Unless otherwise agreed, the Customer shall collect the repaired or replaced
Goods from our premises. Benitachell Video Club may charge the Customer for
storage if the Goods are not collected within 14 days of the date on which we
notify the Customer (by phone or otherwise) that the Goods are available for
collection.6. Payments. Payment of
Benitachell Video Club/One Stop Repair Shop charges shall be made before the Goods are removed from
our premises or within 14 days of the date of notification mentioned in clause
5, whichever is earlier Payment method is by agreement but options are cash,
paypal or bank transfer.
b) If the Customer shall fail to pay all sums due for the repair or replacement
of the Goods, and to collect the Goods within 90 days of the date of the
notification mentioned in clause 5(a), Benitachell Video Club/OneStop Repair Shop may forthwith
sell the Goods at such price as it in its discretion thinks fit and may retain
from the proceeds of sale an amount sufficient to defray the costs of repair
and/or replacement and storage and expenses incurred in attempting to trace the
Customer and in arranging for the sale of the Goods. Any deficiency shall
forthwith be made up by the Customer and if we shall despatch any excess to the
Customer's last known address it shall be under no further liability
whatsoever. No interest shall be payable on any balance retained by us. For
every day after the 60 days has elapsed we will charge a storage fee of €1+IVA.
Software/Data Backup. It is the Customer’s responsibility
to complete a backup of all existing data, software, and programs on Supported
Products prior to performing any Services. WE WILL NOT BE RESPONSIBLE FOR LOSS
OF OR RECOVERY OF DATA, PROGRAMS, OR LOSS OF USE OF SYSTEM(S) OR NETWORK. You
understand and agree that under no circumstances will Benitachell Video Club/One Stop Repair Shop be
responsible for any loss of software, programs, or data, even if our
technicians have attempted to assist you with your backup, recovery, or similar
services. Any such assistance is beyond the scope of any warranty and this
Service Agreement. The assistance is provided in our sole discretion and
without any guarantee or warranty of any kind. Neither do we provide any
guarantee or warranty of any kind with respect to any third-party product that
our technician may use in assisting you.
